In diesem Buch ist die Geschichte der Wiederentdeckung des Palimpsests mit den Gaius-Institutionen durch Barthold Georg Niebuhr neu verhandelt. Die jüngst wiederbelebte These von einer „angekündigten Entdeckung“ wird in Frage gestellt. Das verzerrte Bild des Niebuhrschen Fundes in der Sicht dieser These ist kein Zufall. Es stellt sich vielmehr als später Nachklang wissenschaftlicher Querelen jener Zeit dar. In the archives of the Berlin-Brandenburgische Akademie der Wissenschaften two letters by Barthold Georg Niebuhr of September 1816 are preserved which have never been published in a scholarly edition. The present transcription of the text is diplomatical. Furthermore the letters are examinated in their historical context. The use made of these letters in an anonymous publication in the same year in the Allegmeine Literatur-Zeitung is also discussed.

In the light of unpublished material this paper reconstructs the history of the deciphering of Gaius’ palimpsest of the Capitular Library of Verona (BCapVr, Cod. XV) by Friedrich Bluhme. It deals for the first time with other copies of Bluhme’s transcriptions preserved at the Bonn University Library (ULB, S 675f; ULB, S 1440) and with their relationship to the ones at the Berlin State Library – Prussian Cultural Heritage (SBB-PK, Ms. lat. fol. 308, K. 2, Beil. 2, Fasz. 1).

Sulla base di una riconsiderazione complessiva delle fonti e della letteratura in argomento si affronta nuovamente la questione relativa alla ricostruzione del testo del primo commentario delle Istituzioni di Gaio (Gai 1.119) e si affaccia l'ipotesi che nel testo si leggesse in origine 'rem et aes tenens'.

The discovery of the Palimpsest of the Gaius' Institutions in 1816 occurred at the height of palimpsest research and is part of a broader controversy among German and Italian scholars at that time. The deciphering of the lower stratum of the palimpsest and its first publication was supported by the Preußische Akademie der Wissenschaften and was considered as a product of German intellectual spirit. The transcriptions were transferred to the Akademie der Wissenschaften and later to the Königliche Bibliothek of Berlin. Today they are preserved in the Staatsbibliothek zu Berlin. They still constitute an indispensable basis for the constitutio textus of Gaius' Institutions.

This paper addresses the question of the origin of the partial transcription of Gaius’ palimpsest still preserved in the Capitular Library of Verona (BCapVr, Cod. DCCCIX) and allows to solve the pretended «mystery» about its presence in this library. A comparison with the fair copy (Reinschrift) of the transcription belonging to the Berlin State Library – Prussian Cultural Heritage (SBB-PK, Ms. lat. fol. 308, K. 1, Konv. 1) shows that the Cod. DCCCIX of the Capitular Library can not be regarded as a forgotten copy or a gift. Similarly, the idea that the manuscript was the first fair copy of the transcription works is not plausible. On the basis of unpublished manuscript materials – especially a letter from 22nd April, 1866 – this paper reconstructs some unknown aspects of the background and of the evaluation of Wilhelm Studemund’s apograph of the Institutes of Gaius published in 1874 and its Supplementa published in 1884. Particular attention is paid to the use of chemical substances for the decipherment of the Gaius’ palimpsest.
Gai 4.21 e la presunta manus iniectio ex lege Aquilia

In this paper the idea that the legis actio per manus iniectionem could be applied for the case of the so called lex Aquilia de damno is disputed. There are no valid reasons to reject Göschen’s proposal to correct into ‘aliqua’ the word ‘aquilia’ which ends the line 15 in the fol. 96 uerso of the palimpsest of Gaius’ Institutes. On the contrary, a global evaluation of many aspects, both philological and juridical, leads to the conclusion that Göschen’s reading of Gai 4.21 has to be accepted.
